These Terms and Conditions ("Terms") govern your access to and use of Mojo Verify's identity verification and fraud prevention services ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service.

1. Service Description

1.1 Program Name

Mojo Verify - AI-Powered Identity Verification & Fraud Prevention Platform

1.2 Description

Mojo Verify provides:

• Identity Verification: Government ID validation, liveness checks, document analysis
• Contact Verification: Email, phone, and address validation
• Fraud Prevention: IP analysis, device tracking, risk scoring
• Compliance Screening: OFAC sanctions, adverse media, gaming exclusion lists
• AI Analysis: Private LLM-powered confidence scoring and automated KYC review
• Custom Data Capture: Flexible form fields and customer-defined data collection

1.3 Access Methods

You may access the Service through:

• Web Portal: Browser-based interface for manual verification requests
• REST API: Programmatic access for integration with your applications
• Mobile App: Government ID capture application (when applicable)

2. Account Registration and Access

2.1 Account Creation

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

2.2 Account Responsibilities

You are responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your API keys
• Compliance with all applicable laws when using the Service
• Obtaining necessary consents from end users before collecting their data

2.3 Account Suspension

We may suspend or terminate your account if:

• You violate these Terms
• Your account is used for fraudulent or illegal activity
• You fail to pay fees when due
• We are required to do so by law

3. Pricing and Payment

3.1 Pricing Structure

Pay As You Go - You are charged per verification check:

• IP Analysis / GeoLocation: $0.005 per check
• Email Verification: $0.01 per check
• Phone Verification: $0.05 per check
• OFAC / Sanctions: $0.05 per check
• Gaming Self-Exclusion: $0.05 per check
• SSN Verification: $0.25 per check
• Liveness Check: $0.25 per check
• ID + Liveness Match: $0.25 per check
• Adverse Media Detection (AI): $0.50 per check
• Government ID Verification: $1.50 per check
• Custom Fields: Included
• Portal Access & Private LLM Analysis: Included

Enterprise Pricing: Volume discounts available. Contact sales@mojoverify.com for custom pricing. Enterprise includes lower per-check rates and OFAC/Gaming Exclusion at no additional charge.

3.2 Billing

• Charges are billed monthly in arrears
• You will receive an invoice via email
• Payment is due within 15 days of invoice date
• We accept credit card, ACH, and wire transfer

3.3 No Refunds

Verification checks are processed immediately and cannot be reversed. Fees are non-refundable except in cases of Service error or overcharging.

3.4 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, and other taxes.

5. Acceptable Use

5.1 Permitted Use

You may use the Service to:

• Verify identities for legitimate business purposes
• Comply with KYC/AML regulations
• Prevent fraud and protect your business
• Screen for sanctions and adverse media

5.2 Prohibited Use

You may NOT use the Service to:

• ❌ Violate any laws or regulations
• ❌ Discriminate against protected classes
• ❌ Make credit, employment, insurance, or housing decisions (unless you are FCRA-compliant)
• ❌ Harass, stalk, or harm individuals
• ❌ Resell or redistribute our Service without authorization
• ❌ Reverse engineer or attempt to access our systems without permission
• ❌ Submit false or misleading information
• ❌ Overload or disrupt our infrastructure

6. Data and Privacy

6.1 Your Data

You retain ownership of all data you submit to our Service. We process this data solely to provide the Service to you.

6.2 Our Processing

By using the Service, you grant us permission to:

• Process and analyze submitted data
• Use our private LLM to generate confidence scores
• Store data for compliance and fraud prevention purposes
• Retain verification records as required by law

6.3 Privacy Policy

Our Privacy Policy describes how we collect, use, and protect information. By using the Service, you agree to our Privacy Policy.

6.4 End User Consent

You are responsible for obtaining all necessary consents from end users before submitting their information to our Service. This includes consent for identity verification, data processing, and communication.

7. Intellectual Property

7.1 Our Rights

We retain all rights to:

• The Mojo Verify platform, software, and APIs
• Our AI models, algorithms, and analysis tools
• Our trademarks, logos, and brand assets
• All documentation and materials we provide

7.2 Your License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service during your subscription, subject to these Terms.

7.3 Feedback

If you provide feedback or suggestions about our Service, we may use this feedback without obligation or compensation to you.

8. Service Availability and Support

8.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance.

8.2 Support

Pay As You Go: Email support during business hours

Enterprise: Priority support with dedicated account management

8.3 API Rate Limits

We may implement rate limits to protect Service quality. Limits vary by plan and will be communicated via API documentation.

9. Warranties and Disclaimers

9.1 Service Accuracy

We strive to provide accurate verification results, but we do not guarantee 100% accuracy. Verification results are provided as guidance and should be considered alongside other information.

9.2 Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 Third-Party Data

We rely on third-party data sources. We are not responsible for errors or omissions in third-party data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOJO VERIFY SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• DAMAGES RESULTING FROM ERRORS, INACCURACIES, OR VERIFICATION RESULTS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Mojo Verify from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights
• Your failure to obtain necessary end user consents

12. Term and Termination

12.1 Term

These Terms remain in effect as long as you use the Service.

12.2 Termination by You

You may terminate your account at any time by contacting us. You remain responsible for charges incurred before termination.

12.3 Termination by Us

We may terminate your access immediately if you violate these Terms or for any other reason with 30 days' notice.

12.4 Effect of Termination

Upon termination:

• Your access to the Service will cease
• Outstanding fees become immediately due
• We may retain data as required by law
• Provisions that should survive (payment, liability, etc.) remain in effect

13. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you via:

• Email to your registered address
• Notice in our portal
• Updated "Last Updated" date

Continued use of the Service after changes constitutes acceptance. If you don't agree, you must stop using the Service.

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court. Arbitration shall take place in California.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mojo Verify.

14.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

14.5 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

14.6 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.
