End User Terms of Service

These End User Terms of Service ("Terms") govern your access to and use of the Mojo Verify identity verification service as an individual end user. By creating an account, completing a verification step, or using "Sign in with Mojo Verify," you agree to be bound by these Terms.

Please read these Terms carefully before registering or submitting any personal information.

1. Definitions

  • "Mojo Verify," "we," "us," or "our" means the company operating the Mojo Verify identity verification platform.
  • "Service" means the Mojo Verify end-user identity verification platform, including the registration page, the verification steps, your Account, and the "Sign in with Mojo Verify" feature.
  • "Account" means the personal account you create with Mojo Verify to store your identity verification status.
  • "Verification Step" means each individual check you may elect to complete, including phone verification (SMS OTP), SSN verification, liveness check (biometric), and government ID capture and validation.
  • "KYC Tier" or "Verification Status" means the summary level assigned to your Account based on which Verification Steps you have successfully completed. A KYC Tier is a classification only—it is not a guarantee, endorsement, or promise of eligibility for any product or service offered by any third party.
  • "Participating Partner" means a third-party website or application that supports "Sign in with Mojo Verify." Partners are independent of Mojo Verify and set their own eligibility requirements. Mojo Verify does not control Partners' acceptance decisions.
  • "Sign in with Mojo Verify" or "SSO" means the feature that allows you to authenticate with a Participating Partner and optionally share your KYC Tier and Verification Status with that Partner, with your explicit consent at the time of each connection.

2. Eligibility and Account Creation

2.1 Age Requirement

You must be at least 18 years of age (or the age of legal majority in your jurisdiction, if greater) to create an Account or use the Service. By registering, you represent that you meet this requirement.

2.2 Accurate Information

You must provide accurate, current, and complete information during registration and keep it updated. Submitting false, misleading, or another person's identity information is strictly prohibited and may result in immediate account termination and referral to law enforcement.

2.3 One Account Per Person

Each Account represents one natural person. You may not create multiple Accounts for yourself or create an Account on behalf of another person.

2.4 Account Security

You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account. Notify us immediately at support@mojoverify.com if you believe your Account has been compromised.

3. Verification Steps and Sensitive Data

3.1 Optional Verification Steps

During registration, you may select which Verification Steps to complete. Each step is optional unless required by a Participating Partner you wish to connect with. Available steps include:

  • Phone Verification: You provide your mobile phone number. We send a one-time passcode (OTP) via SMS to confirm ownership. Selecting this step requires you to receive transactional SMS messages. SMS messages are necessary to complete this verification step.
  • SSN Verification: You provide your Social Security Number for identity matching against third-party data sources. This is sensitive personal data. Your SSN is processed solely for verification and is not retained in plain text beyond what is necessary to complete the check.
  • Liveness Check: You capture a short video or image of your face. Biometric information (facial geometry) is processed to confirm you are a live person presenting your own face. By selecting this step, you explicitly consent to the collection and processing of your biometric information for liveness detection purposes. See our Privacy Policy for details on how biometric data is handled and retained.
  • Government ID Capture and Verification: You upload or capture an image of a government-issued photo ID (e.g., driver's license, passport). The image is analyzed to validate the document and match your identity. By selecting this step, you consent to the capture and processing of your government ID document and associated identity data.

3.2 Consent to Process Sensitive Data

By selecting a Verification Step and proceeding, you provide explicit consent to Mojo Verify to collect and process the associated personal and sensitive data for identity verification purposes. Each sensitive data type (biometric, SSN, government ID) requires a separate, explicit acknowledgment on the registration form before processing occurs.

3.3 Do Not Submit Others' Information

You must only submit your own personal information. Submitting another person's data without their consent is prohibited, may constitute identity fraud, and may result in civil or criminal liability.

4. KYC Tier and Partner Sharing

4.1 What Your KYC Tier Means

Upon completing one or more Verification Steps, your Account is assigned a KYC Tier reflecting which checks were successfully completed. Your KYC Tier is a summary classification only. It is not a guarantee of eligibility for any product, service, or transaction. Participating Partners independently determine whether a given KYC Tier meets their requirements.

4.2 What We Share With Partners — and What We Do Not

When you use "Sign in with Mojo Verify" to connect with a Participating Partner, Mojo Verify shares only the following:

  • Your KYC Tier / Verification Status (e.g., "Tier 2 — Phone + ID Verified")
  • Which Verification Steps you have completed (e.g., "phone verified, government ID verified")

Mojo Verify does not share with Partners:

  • Your SSN or any portion thereof
  • Government ID images or scans
  • Liveness check video or images
  • Biometric data
  • Date of birth
  • Full address
  • Any other raw KYC artifact

This limitation applies unless you separately and explicitly authorize a specific additional disclosure in a separate consent flow for that purpose.

4.3 Permissioned Sharing — Your Authorization

Sharing with a Participating Partner occurs only when you actively choose to connect or sign in with that Partner using "Sign in with Mojo Verify." Each connection is a discrete authorization event. By initiating a connection, you authorize Mojo Verify to share your KYC Tier and completed Verification Steps with that specific Partner at that time.

4.4 Revoking Partner Access

You may revoke a Participating Partner's access to your Mojo Verify KYC status at any time through your Account settings. Revoking access prevents future sharing with that Partner. However, information already shared with a Partner prior to revocation may be retained by that Partner subject to their own privacy policy. Mojo Verify is not responsible for a Partner's use or retention of data that was previously shared with your authorization.

4.5 Partner Independence

Participating Partners are independent third parties. Your KYC Tier can be used with Participating Partners that support "Sign in with Mojo Verify." Each Partner decides whether your Verification Status satisfies their requirements. Mojo Verify makes no representation regarding Partner acceptance.

5. SMS and Communication Terms

5.1 SMS Program Details

Program Name: Mojo Verify — Identity Verification (KYC) Messaging

Program Description: When you select phone verification or complete other verification steps that require mobile delivery, Mojo Verify sends you transactional SMS messages. These messages include:

  • One-time passcodes (OTP) to verify your phone number
  • Verification status updates
  • Secure links to complete pending verification steps

Mojo Verify does not send marketing or promotional SMS messages under this program. All messages are transactional and directly related to your active identity verification.

Opt-In: You opt in to receive SMS messages by selecting "Verify Phone" on the Mojo Verify registration form, reviewing the disclosure text displayed on that form, and checking the SMS consent checkbox before submitting. The public registration and consent page is available at:

Disclosure shown before opt-in:

"By continuing, you agree to receive SMS messages from Mojo Verify related to completing your identity verification. Message frequency varies (typically 1–5 messages per verification session). Msg & data rates may apply. Reply STOP to opt out. Reply HELP for help."

Consent is not a condition of purchase. If you select "Verify Phone," SMS messages may be necessary to complete that specific verification step. You may choose not to verify your phone number if you do not wish to receive SMS messages; other verification steps remain available.

Message Frequency

Message frequency varies. Typically 1–5 messages per verification session; OTP requests generate 1–2 messages per request.

Opt-Out Keywords

You may opt out at any time by replying with any of the following keywords: STOP, STOPALL, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE

Upon receiving your opt-out keyword, we will send you a single confirmation message acknowledging that you have been unsubscribed and that no further messages will be sent. Note: opting out of SMS may prevent completion of phone-dependent verification steps.

6. Privacy and Data Use

6.1 Privacy Policy

Our Privacy Policy describes in detail how we collect, use, store, and protect your personal information, including biometric data and government identification information. The Privacy Policy is incorporated into these Terms by reference.

6.2 Retention for Compliance and Fraud Prevention

Mojo Verify retains your verification records, consent records, and associated metadata (including IP address, timestamp, user agent, and the version of disclosures accepted) for compliance with applicable law and for fraud prevention purposes. Verification records are typically retained for up to seven (7) years. Requesting account deletion does not automatically remove records subject to legal retention obligations.

6.3 Consent Recordkeeping

Mojo Verify records and stores evidence of your consent at the time you register, including: the date and time of registration, your IP address, your browser user agent, the version of disclosure text you acknowledged, which verification steps you selected, and which consent checkboxes you checked.

6.4 No Sale of Personal Data; No Marketing Use of Mobile Data

We do not sell your personal data to third parties. We do not share your mobile phone number or mobile opt-in consent data for marketing purposes. Your phone number and SMS consent are used solely to send you transactional messages related to your identity verification.

7. Disclaimers and Limitation of Liability

7.1 Verification Results Not Guaranteed

THE SERVICE IS PROVIDED "AS IS." MOJO VERIFY DOES NOT GUARANTEE THAT ANY VERIFICATION STEP WILL SUCCEED, THAT YOUR KYC TIER WILL BE ACCEPTED BY ANY PARTICIPATING PARTNER, OR THAT VERIFICATION RESULTS ARE FREE FROM ERROR. A SUCCESSFUL VERIFICATION DOES NOT CONSTITUTE LEGAL ADVICE, FINANCIAL ADVICE, OR A GUARANTEE OF ELIGIBILITY FOR ANY PRODUCT OR SERVICE.

7.2 Exclusion of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOJO VERIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR RELIANCE ON VERIFICATION RESULTS.

7.3 Liability Cap

MOJO VERIFY'S TOTAL AGGREGATE LIABILITY TO YOU FOR CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold harmless Mojo Verify and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your submission of false, fraudulent, or another person's information
  • Your violation of applicable law
  • Your misuse of the Service or your KYC Tier

9. Term, Termination, and Account Deletion

9.1 Term

These Terms remain in effect from the date you create your Account until your Account is closed.

9.2 Account Deletion by You

You may request deletion of your Account at any time by contacting support@mojoverify.com. Upon receiving a valid deletion request:

  • Your active Account and login credentials will be removed
  • Future "Sign in with Mojo Verify" events will no longer function
  • Verification records may be retained as required by law or for fraud prevention, as described in Section 6.2

9.3 Outstanding Verification Sessions

If you request account deletion while a verification session is in progress, any pending verifications will be cancelled. In-progress SMS OTP sessions will be terminated and opt-out will be processed.

9.4 Termination by Mojo Verify

We may suspend or terminate your Account if you violate these Terms, submit fraudulent or false information, or if required by law. We will endeavor to notify you except where prohibited by law or where immediate action is required to protect the Service or other users.

9.5 Survival

Sections 1, 6, 7, 8, 10, 11, and 12 survive termination of your Account.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

10.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, with arbitration seated in California. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Injunctive Relief Carve-Out: Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm, without waiving the right to arbitration for all other disputes.

Class Action Waiver: All claims must be brought in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding.

11. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you via email to your registered address (if you have provided one) or by displaying a prominent notice through the Service. We will also update the "Last Updated" date at the top of this page. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you should stop using the Service and may request account deletion.

12. General Provisions

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

12.2 No Waiver

Mojo Verify's failure to enforce any right or provision will not constitute a waiver of that right or provision.

12.3 Assignment

You may not assign or transfer your Account or these Terms. Mojo Verify may assign these Terms, including in connection with a merger, acquisition, or sale of assets. Any purported assignment by you is void.

12.4 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mojo Verify regarding your use of the Service as an individual user.
